The fact that any improved real property located within the county is designed for occupation or use, is occupied or used, or is capable of being occupied or used, shall be prima facie evidence that solid waste is being produced or accumulated upon such property. The owner of such property shall be responsible for insuring that any solid waste generated upon such property is being managed in accordance with the terms and provisions of this part, and may be required by the director to show to the satisfaction of the director that such management is being done.(Act 81-450, p. 773, §12.)
