Section 45-51-20 - Refusal by Wholesale Licensee to Sell to Retail Licensee; Remedies

(a)(1) This section shall only apply to specified licensees of the Alcoholic Beverage Control Board operating in Montgomery County. (2) The purpose of this section is to regulate the liquor traffic in Montgomery County pursuant to Section 104 of the Constitution of Alabama of 1901. (b) No holder of a wholesaler license issued by the Alcoholic Beverage Control Board shall refuse to sell to a holder of a retail license issued by the Alcoholic Beverage Control Board or to provide a service to a holder of a retail license, if the same service is provided to other holders of a retail license.(c)(1) A person or business entity may bring an action for a declaratory judgement for a determination of any controversy under this section. (2) A person or business entity, upon proper application to a court, may obtain injunctive relief against any violation of this section.(3) These remedies are not exclusive and this section shall not be construed as abolishing any other available cause of action.
