Section 45-54-230 - Compensation

(a) Commencing on May 1, 1999, the Sheriff of PickensCounty shall be entitled to an additional expense allowance totalling thesalary and expense allowance in an amount equal to 63 percent of the annualsalary paid by the State of Alabama to the District Judge of Pickens County,which shall be in addition to all other expense allowances, compensation, orsalary provided by law. (b) Beginning with the expiration of the term of theincumbent sheriff, the annual salary for the sheriff shall be increased to anamount equal to 63 percent of the annual salarypaid by the state to the DistrictJudge of Pickens County, payable in equal monthly installments and at that time, subsection (a) shall becomenull and void.(c) The salary prescribed for the Sheriff of Pickens Countypursuant to subsection (b) shall be 63 percent of the annual salary prescribedby law for the District Judgeof Pickens County,and shall increasein the amount as the salary of the district judge isincreased by law. If theimplementation of any increase in the salary of the District Judge of PickensCounty increases the salary of the sheriff during his or her term of office,the increase shall be paid as

If theimplementation of any increase in the salary of the District Judge of PickensCounty increases the salary of the sheriff during his or her term of office,the increase shall be paid as expense allowance until the beginning of the nextterm of office, whereupon the amountof the expense allowance shallbe included in the salaryfor the sheriff and theexpense allowance at that time shall become null and void. Notwithstanding the foregoing, the county shall pay the salary increase during a termof office at the beginning of the next fiscal year after the implementation ofthe increase if payment of the increase shall at any time become authorized by an amendmentto the Constitution of Alabamaof 1901.(d) Any expense allowance provided for by this section and the annualsalary of the Sheriff of Pickens County provided for by this section, whetherenacted herein or implemented after April 29, 1999, shall be payablein equal installments out ofthe general fund of the county, out of the county public highway and trafficfund, or any other fund available to the Pickens County Commission, as thePickens County Commission shall direct.(Act 99–172, p. 199, §§ 1–4.)
