The authority of the county engineer shall be limitedto the expenditure of such funds for the purpose of construction, maintenance,or repair of public roads, highways, bridges, and ferries of the county as maybe set aside and appropriated by the county commission. It shall be the duty of the county commission at some meeting inSeptember of each calendar year, or not later than the first meeting inOctober, to fix and determine the amount of funds which will be available forthe purpose of building, maintaining, and constructing public roads,highways, bridges, and ferries of the county for the current fiscal year. Provided, however, the county commissionis authorized, from time to time, to increase the amount so allowed to beexpended by the county engineer, when the authorization will not conflict withgeneral law under the budget act, Chapter 8, Title 11. Provided further, that if such funds are presently available andhave not heretofore been set aside by the present Pike County Commission,immediately upon November 23, 1988, it shall be the duty of the county commission to set aside a ds are presently available andhave not heretofore been set aside by the present Pike County Commission,immediately upon November 23, 1988, it shall be the duty of the county commission to set aside a sufficientportion of the funds for the maintenance ofroads, highways, bridges, and ferries until themeeting in September or October.(Act 88–894, 1st Sp.
