(a) The Pike County Commission, by resolution of thecommission or pursuant to a referendum as provided for in subsection (b) mayregulate and permit the sale of alcoholic beverages outside of the corporatelimits of the City of Troy for on-premises and off-premises consumption after 12:00 p.m. onSundays, as determined by the county commission, by properly licensedretail licensees of the Alcoholic BeverageControl Board servingthe general public.(b) Subsection (a) may be conditioned on approval at a referendum election of the qualifiedelectors of the county outside of the corporate limits of the City of Troy whovote in an election to be held on a day designated by the county commission. If the Pike County Commission chooses tocall for the approval of this section by a referendum election, the countycommission cannot later approve this section by resolution and this section canonly be approved by a referendum election as provided in this section. If a referendum is called for, thenotice of the election shall be given by the county commission, and theelection his section canonly be approved by a referendum election as provided in this section. If a referendum is called for, thenotice of the election shall be given by the county commission, and theelection shall be held, conducted, and the results canvassed in the manner asother county elections. The electionshall be held in conjunction with a regularly scheduled state or local electionto be held in the county. Thequestion shall be, ‘‘Do you favor the adoption of Act 255, of the 2018 RegularSession of the Alabama Legislature authorizing the sale of alcoholic beveragesafter 12:00 p.m. on Sundaysoutside of the corporate limits of the City of Troy? Yes ( ) No ( ).’’ The county shall pay any costs and expenses not otherwisereimbursed by a governmental agency which are incidental to the election. If a majority of the votes cast in theelection are ‘‘Yes,’’ subsection (a) shall become operative immediately. If the majority of the votes are ‘‘No,’’ asecond election may not be held less than one year after the prior election.(Act 2018–255, §§ 1, 2.)
