Section 45-56-120 - Employees’ Retirement System; Withdrawing Accumulated Contributions

(a) Any individual who became a member of the Employees’Retirement System through the participation of Randolph Countyin the system, who was a member of the system on October 1,1975, and who prior to that date had been ineligible to receive credit forservice rendered as an employee prior to October 1, 1945, for reasons otherthan having been employed as a nonmember,shall be eligibleunder Article 1, Chapter 27, Title 36, to receivecredit for all service as anemployee rendered by him or her prior to the date of establishment of theretirement system; provided, that theindividual has never waived his or her claim on the funds of the retirementsystem by withdrawing his or her accumulated contributions to the fund; and provided, the member has not beenabsent from service more than five years in any period of six consecutive yearsafter becoming a member of the retirement system.(b) This section shall apply to both present employees ofRandolph County and retired employees of Randolph County.(Act 86–629, 1st Sp.
