Section 45-56-160 - Reimbursement from General Fund; Office of Judge of Probate

(a) The Randolph County Commission shall reimburse theoffice of the judge of probate or license commissioner from the general fund ofthe county the amount of any monetaryloss, not to exceed a total of three thousandfive hundred dollars($3,500) per annum,arising or causedby error, if the mistake or omission was caused withouthis or her personal knowledge, including loss arising from acceptance ofworthless or forged checks, drafts, money orders, or other written orders for money or its equivalent.(b) It shall be the duty of the judge of probate or license commissioner toensure that his or her employees exercise due care in performing their dutiesand to make a diligent effort to correct the error, mistake, or omission andcollect the amount subject to potential loss immediately upon becoming aware of the potential loss. This section shall not apply to anydeliberate misuse or misappropriation of fundsby the official or any clerk or employee of his or heroffice.(Act 85–627, p. 957, §§ 1, 2.)
