(a) The Randolph County Commission, by ordinance of thecounty commission, may regulate the distance from a church or school that alicensee of the Alcoholic Beverage Control Board may be located in theunincorporated area of the county.Any ordinance enactedpursuant to this section shall not apply toany licensee of the Alcoholic Beverage Control Boardoperating pursuant to a license granted before January 30,2014, or to a licensee operating lawfully pursuant to the ordinance before anychange in the location or the establishment of a school or church affectingthe operation of a licensee pursuant to theordinance. Any distance pursuant tothe ordinance shall be specified fromthe property line of the licensee to the property line of the church or school.(b) Any ordinance adopted pursuant to this section may be enforced by acivil penalty levied by the Randolph County Commission not to exceed fivehundred dollars ($500) per day for each day of violation after notice and ahearing before the county commission. Inaddition, the ordinance of the county commission may be enforcedby injunctive reliefin the Circuit Court of Randolph County.(Act 2014–4, p. 19, § 1.)
