§ 45-56-83-61

The following words and phrases,including the plural of any thereof,whenever used in this subpart,shall have the following respective meanings: (1) GENERALPROPERTY INSTRUMENT. A real property instrument that affects the titleto personal property as well as real property.(2) IMPROVEDRECORDING SYSTEM. A system ofrecording real property instruments and personalproperty instruments in the probateoffice and, in the discretion of the judge ofprobate, of recording other instruments and documents, which system whencompleted, shall consist of the equipment necessary and suitable to record,archive, and retrieve records.(3) PERSONALPROPERTY INSTRUMENT. Anyinstrument or document affecting the title to personal property only, asdistinguished from real property, that may now or hereafter be required to befiled or titled for record in the probate office, in accordance with the applicable requirements of the laws of thisstate, including, withoutlimitation, Sections 35–4–50and 35–4–90.(4) REAL PROPERTYINSTRUMENT. Includes anyinstrument or document affecting the title to real property that may now or hereafterbe filed for record in the

withoutlimitation, Sections 35–4–50and 35–4–90.(4) REAL PROPERTYINSTRUMENT. Includes anyinstrument or document affecting the title to real property that may now or hereafterbe filed for record in the probate office pursuant to the applicable requirements ofthe laws of this state, including, without limitation, Section 12–13–43, andall statutes providing for the filing and recording of notices or statements ofliens of any kind, notices of judgment, and plats or maps showing subdivisions of real estate.(Act 98–592, p. 1299, § 2.)
