02Licensing and Operation of Junkyards.(a) No person shall establish, operate, or maintain ajunkyard or similar establishment containing any items listed in Section45–57–170, but not limited to thoseitems, any portionof which is within 1,000feet of the nearestedge of the right-of-way of any highway, road, street, or alley withoutobtaining a county permit to do so from the county commission through thecounty license commissioner or other licensing official. No permit shall be granted except for those junkyards or similarestablishments which have a privacy fence so as not to be visible from thehighway. The operation of anunpermitted junkyard or similar establishment required to be permitted pursuantto this section constitutes a public nuisance. (b) The county commission shall adopt regulations and requirements forissuing permits for the operation of junkyards or similar establishments withinthe limits defined in this subpart, and may revoke the permit at any time a junkyard or similar establishment fails to conformto the requirements of this subpart, and shall charge a permit fee ofnot more than one thousand dollars ($1,000) nor less than one hundred dollars($100) kyard or similar establishment fails to conformto the requirements of this subpart, and shall charge a permit fee ofnot more than one thousand dollars ($1,000) nor less than one hundred dollars($100) payable each fiscal year. Thispermit fee shall be in addition to the license fee required under Section23–1–244, and any other license fee or tax required by law. All permits issued under this subpartshall expire on September 30 following the date of issue. Permits may be renewed from year to year uponpayment of the fee.
