27Enforcement by Abatement.(a) In addition to the above provisions, the county commission may enforcethis subpart by the commencement of a civil action to abate or enjoin anypublic nuisance pursuant to this subpart. Priorto commencing a civil action, the county commission shall give reasonablenotice to the owner of the real property to abatethe alleged nuisanceand the ownerof the real property may request a reasonable time to abate or have abated the condition on the land. (b) In the action, the court shall enter a judgment for all costs ofabating the public nuisance declared by this subpart, including attorney’sfees, court costs, and all other expenses of litigation, against the personcreating or maintaining the public nuisance.
