(a) Pursuant to the authority of Section 104 of the Constitution of Alabamaof 1901, on and after August 1, 2005, the Alcoholic Beverage Control Board maynot issue a license to any person or other entity to sell any alcoholicbeverage for on-premises or off-premises consumption, nor for the consumption of alcoholic beverages in any bar, restaurant, or other commercialbusiness, or community establishment within 500 feet of a church in Russell County.(b) This section shall not prevent, restrict, or affectthe otherwise legal possession and consumption of alcoholic beverages in aprivate social setting within the prescribed area.(c) Any violation of subsection (a) may be punishable as provided by law.(d) Any personwho violates subsection (a) may be subject to any disciplinary action by theboard authorized by law.(e) Thissection shall not apply to any person holding a license within the prescribedarea on August 1, 2005.(Act 2005–149, p. 265, §§ 1–5.)
