50Recorded Roll Call Vote.(a)(1) The County Commission of Russell County, upon the adoption of aresolution by a recorded roll call vote, may levy an additional annual issuancefee of up to ten dollars ($10) on each motor vehicle registration in thecounty. This issuance fee shall be inaddition to all other charges, costs,taxes, or fees levied on the issuance of all annual motor vehicle registrations. (2) Those persons exempt from paying ad valorem taxesunder Section 40–9–21, are exempt from the annual issuance fee authorized bythis section for one motor vehicle per year.(b) The annualissuance fee shall become due at the same time the state license and registration fee becomes due pursuant to Section 32–6–61,provided the fee shall not be collected more than once in a 12–monthperiod per motor vehicle. (c)(1) The county commission may adopt rules necessary for the collectionand enforcement of the issuance fee authorized by this section and may expendproceeds from the fees as may be necessary to collect and enforce the issuancefee. (2) The remaining proceedsshall be distributed as follows: a. issuance fee authorized by this section and may expendproceeds from the fees as may be necessary to collect and enforce the issuancefee. (2) The remaining proceedsshall be distributed as follows: a. Forty percent of the proceeds from the fee authorizedby this section shall be depositedinto the General Fund of the City of Phenix City to be used for the building,repair, and maintenance of roads, bridges, and sidewalks located within the corporate limitsof Phenix City.b. Sixty percent of the proceeds from the fee authorizedby this section shall be depositedinto the county general fund to be expended at the discretion of the countycommission. Of this amount, thecounty commission may deposit a percentage of the proceeds deposited in thecounty general fund in the General Fund of the City of Hurtsboro to be used forthe building, repair, and maintenance of roads, bridges, and sidewalks locatedwithin the corporatelimits of the City of Hurtsboro.
