01Service of Process Fund.(a) The Russell County Sheriff Service of Process Fund iscreated and hereinafter referred to as the fund. (b) The Sheriff of Russell County, except for warrants forarrest, may contract with or enter into an agreement with a private, public, orgovernmental entity for the purpose of service of process.(c)(1) In addition to all existing charges,fees, judgments, and costs of court,the clerk, sheriff, or other appropriate court official in the civil divisionof the district and circuit courts of RussellCounty shall assessa service of process fee of fifteen dollars ($15) per document, and the fees shall bedistributed according to this subsection.(2) Thecourt official designated in Russell County by law for the respective courtsshall collect the service of process fee designated in this subsection and shall remittwo-thirds of the fees collected to the sherifffor deposit into the fund and one-third of the fees collected to the circuitclerk fund. (d) The sheriffmay use the monies generated by this section for law enforcement purposes inthe county, at the discretion of the sheriff, including contracting with orentering into a contract or agreement

The fundsmay not revert to the general fund of the county at the end of the fiscal year. (e) Theestablishment of the fund and the use of the proceeds may not diminish or takethe place of any other source of income established for the sheriff or theoperation of the jail. (f) The districtattorney, law enforcement, and grand juries shall be exemptfrom payment of the fees provided by this section. (Act 2017–437, p. 1466, § 1.)
