07Adopting Code of Regulations Applicable to Subdivision of Land.The planning commission shall adopt a code of regulations applicable to the subdivisionof land. Plats of subdivisions, afterthe adoption of the code of regulations, shall not be acceptedfor filing and recording in the probateoffice until they have been approved in a manner to be designated by theplanning commission. The planningcommission may provide a penalty not to exceed one hundred dollars ($100) perday, per lot, until violation is corrected. Thepenalty shall be paid by anyone who subdivides property and conveys lotstherefrom without first having recorded the plat of the subdivision as isherein provided. Penalties shall bedeposited to the operating funds of the planning commission. The provisions of this section shall applywithin the jurisdiction of the planning commissionas specified in Section 45–57–260.01. (Act 95–573, p. 1198, § 8.)
