44Evaluation Process.(a) Upon application by an offender for admission into thepretrial diversion program and prior to admission thereto and as a part ofthe district attorney’s evaluation process, the district attorney may requirethe offender to furnish information concerning past criminal history, educationhistory, work history, family history, medical or psychiatric treatment or careprescribed or received, psychological tests taken, and any other informationconcerning the offender which the district attorney, in his or her solediscretion, believes has a bearing on the decision to admit or deny theoffender to the program. (b) The district attorney may require the offender to submit to any type oftest or evaluation process or interview which the district attorney deemsappropriate in evaluating the offender. Thecosts of any test or evaluation shall be paid by the offender. The offender shallprovide the districtattorney, upon request, with written consent to receive any additionaleducational, work, medical, psychiatric, and psychological records or any otherrecords deemed necessary by the district attorney.(Act 2012–364, p. 907, § 5.)
