01Liquor Traffic.(a) As a matter of law, the Legislature declares that thissection regulates the liquor traffic within the meaning and intent of Section104 of the Constitution of Alabama of 1901. (b) This section shall apply only to the City of PhenixCity in Russell County. (c)(1) Notwithstanding Section 28–3A–17.1, the governing body of the Cityof Phenix City may establish not more than two entertainment districts withinits corporate limits, each of which may not have fewer than three licensees holdinga restaurant retail liquor license,an on premises alcoholicbeverage license, or other retailliquor license in that area,and each district may not exceed one-halfmile by one-half mile in area, but may be irregularly shaped. (2)a. Upon compliance of the applicant withChapter 3A of Title 28, and the regulations made pursuant to that chapter whichare not in conflict with this section, the Alabama Alcoholic Beverage ControlBoard may issue an entertainment district designation for any retail licenseauthorized in Chapter 3A of Title 28, which allows the licensee of a licensedpremises located in an entertainment district established pursuantto this section to sell esignation for any retail licenseauthorized in Chapter 3A of Title 28, which allows the licensee of a licensedpremises located in an entertainment district established pursuantto this section to sell alcoholic beverages for consumption on the licensedpremises. b. Alicensee who receives an entertainment district designation for an on premises retail license shall complywith all laws, rules, and regulations which govern its license type, exceptthat any patron, guest, or member of that licensee may exit that licensedpremises with an open container of an alcoholic beverage and consume thealcoholic beverage anywhere within the confines of the entertainment district,but may not enter another licensedpremises with an open container or closed container of an alcoholic beverageacquired elsewhere. (3) The permission grantedby subdivision (2) allowing a patron, guest, ormember of a licensee to exit the licensed premisesand consume an alcoholicbeverage anywhere within the confines of the entertainment district shall notextend the confines of the licensed premises. (4) For the purposes of this section, the term on premisesas applied to consumption within an entertainment districtshall include nment district shall notextend the confines of the licensed premises.
