04Assumption of Office.(a) Upon the assumption of office of the elected members of the board ofeducation, the Phenix City Board of Educationshall be createdas provided in this part and the terms, powers, duties,responsibilities, and compensation of the office of the prior members of the boardof education shallterminate. (b)(1) Upon the assumption of office of theelected members of the board of education, the elected members shall have thepowers, authority, duties, and responsibilities as are otherwise provided bylaw for members of city boards of education as set forth in Chapter 11 of Title16. (2) Upon the assumption of office of the elected members of the board ofeducation and at the first meeting of the board in each term thereafter, thechair and vice chair shall be elected by a majority vote of the members of theboard and the vice chair shall preside over meetings of the board in theabsence of the chair. (3) All property, records, supplies, and equipment of the prior board ofeducation shall be vested in the board created by this part. (c) The establishment of the board of education as provided in this partmay not affect or impair any of the following: (1) e prior board ofeducation shall be vested in the board created by this part. (c) The establishment of the board of education as provided in this partmay not affect or impair any of the following: (1) Existing rights or privileges of employees of the board including, butnot limited to, employment, personnel, salary, and retirement rights and privileges.
