(a) It is the intent of this section to permit the City Council of the Cityof Phenix City and the board of trustees of the Firemen’s and Policemen’sPension and Relief Fund to elect by resolution to have the employees of thecity’s fire and police departments participate in the Employees’ RetirementSystem of Alabama and to transfer to that system whatever funds are necessaryto accomplish this, pursuant to Section 36–27–6. (b) To that effect, upon the date of acceptance by the Employees’ Retirement System of the members of the City of Phenix City’s Firemen’s andPolicemen’s Pension and Relief Fund as members of the Employees’ RetirementSystem, the provisions of this part, relating to the establishment of a pensionand relief fund for the firemen and policemen of the City of Phenix City, to the extent the provisions conflict with Section36–27–6, are repealed.
