In the eventthe evidence producedby a photographic traffic signalenforcement system does not produce an image of the license plate withsufficient clarity for a trained technician to determine the identity of the owner, and if the identitycannot otherwise be reliably established, then no notice of violation may beissued pursuant to this subpart. If,however, a notice of violation is issued,to the degree constitutionally allowed,those issues related to the identity of the vehicle orits owner shall affect the weight to be accordedthe evidence and shall not affect its admissibility.(Act 2012–326, p. 758, § 9.)
