(a) Out of a recovery in an action under AS 23.05.220 there shall be paid first, court costs advanced by the department which shall be returned to the department's appropriation for this purpose and second, the wage claim involved. (b) When an action is lost by the department, it shall pay costs out of money appropriated for that purpose.
