13-2919. Automated telephone solicitation; violation; classification A. A person shall not use an automated system for the selection and dialing of telephone numbers and the playing of a recorded message or sending a text message for the purpose of soliciting persons to purchase goods or services or requesting survey information if the results are to be used directly for the purpose of soliciting persons to purchase goods or services. B. This section does not apply if a recorded message or text message is received under any of the following circumstances: 1. With prior express invitation or permission by the recipient. 2. By a recipient who has an existing business relationship with the sender. C. A person who violates this section is guilty of a class 2 misdemeanor.
