13-2922. Interference with transmissions on public safety land mobile radio frequencies; classification; definitions A. It is unlawful for a person to recklessly interrupt, impede or otherwise directly interfere with emergency communications over a public safety land mobile radio frequency communications network or system created for emergency communications. B. It is unlawful for a person to recklessly interrupt, impede or otherwise interfere with the transmission of a nonemergency communication over a public safety land mobile radio frequency that is dedicated to the dispatch of police, fire or emergency medical response personnel to the scene of an emergency or dedicated to use for emergency communications. C. A person who violates subsection A is guilty of a class 6 felony. A person who violates subsection B is guilty of a class 1 misdemeanor. D. As used in this section: 1. ' Emergency' means a situation in which a person is or is reasonably believed by the person transmitting the communication to be in imminent danger of serious physical injury or in which property is or is reasonably believed by the person transmitting the communication to be in imminent danger of damage or communication to be in imminent danger of serious physical injury or in which property is or is reasonably believed by the person transmitting the communication to be in imminent danger of damage or destruction. 2. ' Public safety land mobile radio frequency' means a frequency prescribed in 47 Code of Federal Regulations part 90, subpart B and part 97, subpart A. 3. ' Public safety land mobile radio frequency communications network or system' means those radio services and emergency communications systems that are prescribed in 47 Code of Federal Regulations part 90, subpart B and part 97, subpart A.
