Adjudicated delinquents; firearm possession; classification A person who was previously adjudicated delinquent for an offense that would be a felony if committed by an adult and who possesses, uses or carries a firearm within ten years from the date of his adjudication or his release or escape from custody is guilty of a class 5 felony for a first offense and a class 4 felony for a second or subsequent offense if the person was previously adjudicated for an offense that if committed as an adult would constitute: 1. Burglary in the first degree. 2. Burglary in the second degree. 3. Arson. 4. Any felony offense involving the use or threatening exhibition of a deadly weapon or dangerous instrument. 5. A serious offense as defined in section 13-706.
