13-3812. Examination of complainant; issuance of summons or warrant of arrest When the complaint is laid before the magistrate, he shall examine, on oath, the complainant and any witness he produces, and if there is just reason to believe that the commission of the offense threatened by the person complained of is imminent, the magistrate shall issue a summons, or warrant of arrest, reciting the substance of the complaint. If a warrant of arrest is issued, it shall command the officer to forthwith arrest the person complained of, and bring him before the magistrate.
