Breach and forfeiture; action for recovery; effect of conviction Upon conviction of the person complained against of any breach of the peace, the condition of bond is violated, and the county attorney shall thereupon commence action upon it in the name of the state. In the action, the offense charged in the record of conviction shall be alleged as a breach of the bond, and such record shall be conclusive evidence of the breach.
