23-780. Duration and amount of benefits; definition A. An otherwise eligible individual is entitled during a benefit year to a total amount of benefits equal to: 1. Twenty-six times the individual's weekly benefit amount if the unemployment rate in the prior calendar quarter is five percent or more. 2. Twenty-four times the individual's weekly benefit amount if the unemployment rate in the prior calendar quarter is less than five percent. B. Notwithstanding subsection A of this section, an individual may not receive more than one-third of the individual's base period earnings in a benefit year. C. For the purposes of this section, ' unemployment rate in the prior calendar quarter' means the average of the seasonally adjusted unemployment rates for the three months of the most recently published calendar year quarter as published by the office of economic opportunity.
