27-997. Rules; release, forfeiture or exercise of financial assurance A. The state mine inspector shall adopt rules for reviewing and acting on: 1. Applications to release all or part of the financial assurance under this article. 2. Forfeiture or exercise of the financial assurance on failure to implement a reclamation plan as required by this article. B. The rules shall provide for written notice to all principals and sureties on the financial assurance and an opportunity for a hearing.
