32-1721. Persons and acts not affected by this chapter This chapter does not apply to: 1. Physicians and surgeons duly licensed to practice medicine and surgery in this state, if they are practicing lawfully. 2. Dispensing opticians duly licensed to practice, if they are practicing lawfully in accordance with the provisions of section 32-1671. 3. The sale of complete ready-to-wear eyeglasses as merchandise from a permanently established place of business. 4. A licensed or unlicensed individual performing duties delegated under the authority of a licensee.
