40-338. Accidents on property of public service corporations; investigation; report A. The commission shall investigate the cause of all accidents upon the property of any public service corporation, or directly or indirectly arising from or connected with its maintenance or operation, resulting in loss of life or injury to persons or property, and may make such order or recommendation with respect thereto as is just and reasonable. B. Every public service corporation shall file with the commission a report of each accident so occurring, but the report, order and recommendation, shall not be admitted as evidence in any action for damages arising out of the accident.
