40-845. Violation; penalty; action to collect penalty A. Any person failing to comply with an order or regulation of the commission authorized by this article shall be liable to a penalty of twenty-five dollars for each day of noncompliance. B. The attorney general shall file an action on behalf of the state for any unpaid penalty within one year after the penalty accrues. C. Any common carrier railroad which is unable on or before January 1, 1956, to equip its cabooses as prescribed in this article may apply to the corporation commission for an extension of time. The commission may grant additional time, not to exceed nine months from January 1, 1956, and during such period the common carrier railroad shall not be subject to the fine prescribed by this section.
