41-1609.04. Reimbursing county for expense of prosecution; private prison A. If a person is arrested within this state for any crime described in subsection C of this section, the clerk of the court in which the legal proceedings relating to the crime are held shall prepare an itemized claim against the private prison for the court costs and any other costs or fees incurred by the county upon the prosecution and defense of the case and the cost of confining and keeping the prisoner. The claim shall be certified by the presiding judge of the superior court in that county and sent to the private prison for payment. B. Upon receipt of the certified claim, the private prison shall pay the county treasurer of the county where the legal proceedings were held. The county treasurer shall deposit the monies in the county general fund. C. This section applies to any crime committed: 1. In or adjacent and related to a private prison that is under contract with the department pursuant to section 41-1609. 2. By a person while escaped from a private prison that is under contract with the department pursuant to section 41-1609 or with any political subdivision of the state. 3.
