Section 12-64-404 - Special courts-martial punishments

A special court-martial may, under such limitations as the Governor may prescribe, adjudge one (1) or more of the following punishments:(1) Confinement with hard labor that shall not exceed the lowest of the sentence limitations established in the Manual for Courts-Martial, United States (2019 Edition), as it existed on January 1, 2019, for the offense or one hundred eighty (180) days;(2) A fine or forfeiture of pay and allowances in an amount that shall not exceed the lowest of the sentence limitations established in the Manual for Courts-Martial, United States (2019 Edition), as it existed on January 1, 2019, for the offense or one hundred eighty (180) days of the service member's base pay and allowances;(3) Bad conduct discharge;(4) Reprimand; and(5) Reduction of enlisted persons to a lower grade.Amended by Act 2019, No. 211,§ 8, eff. 2/26/2019.Amended by Act 2015, No. 1003,§ 14, eff. 7/22/2015.Acts 1969, No. 50, § 63; 1985, No. 670, § 8; A.S.A. 1947, § 11-618; Acts 2007, No. 47, § 9.
