(a) Any person who purchases products as provided in § 15-32-411(a) at a price based on the volume or weight of the products shall pay for the products upon the basis of measures as the measures are now or may hereafter be defined by the statutes of this state.(b) Any person who, in making payment for products bought at a price based on volume, makes a payment of an amount less than the correct total when computed as provided in subsection (a) of this section, shall be liable to the seller for the difference between the amount paid and the total when computed as provided in subsection (a) of this section, and, in addition, shall be liable to the seller for a further sum equal to the difference.Acts 1939, No. 57, §§ 3, 4; A.S.A. 1947, §§ 54-314, 54-315.
