Section 16-17-138 - Mandatory holding of court for departments of a district court

(a)(1) A district court shall hold court in each department of the district court at least one (1) time a month unless mutually waived by the district court judge and the governing body of the city or town in which the department is located.(2) The agreement under subdivision (a)(1) of this section shall be in writing and adopted by ordinance of the governing body of the city or town in which the department is located.(b) If the district court does not have a case at the time court is scheduled to be held in a month, the requirement of subsection (a) of this section is waived and court shall be held at the next scheduled time.Added by Act 2015, No. 1031,§ 1, eff. 7/22/2015.
