Section 16-17-801 - Notice

(a) Whenever any person appeals any civil or criminal judgment rendered in any district court of this state and requests a trial de novo in circuit court, no hearing shall be held or trial shall commence in circuit court without ten (10) days' written notice being given either to the parties, to the defendant, or to the attorneys of record, whichever is applicable, by the clerk of the court or by the case coordinator.(b) In the event that the defense requests a continuance because of this section, the time which the trial is delayed is excludable for purposes of speedy trial.Acts 1997, No. 996, § 1.
