Section 16-68-404 - Costs when action unsuccessful against part of several defendants

When several persons are made defendants to any action of trespass, assault and battery, false imprisonment, detinue, replevin, trover, or ejectment, and one (1) or more of them is acquitted, every person so acquitted shall recover his or her costs in the same manner as if the verdict of acquittal had been in favor of all the defendants, unless it is certified by the court that there was reasonable cause for making the person a defendant to the action.Rev.
