Section 16-68-406 - Action in name of married woman - Liability for costs

In an action brought or defended by any married woman, in her name, neither her husband nor his property shall be liable for the costs thereof, or the recovery therein. In an action brought by her for an injury to her person, character, or property, if judgment passes against her for costs, the court in which the action is pending shall have jurisdiction to enforce payment of the judgment out of her separate estate or property.Acts 1873, No. 126, § 6, p. 382; C. & M.
