Section 16-85-101 - Right to attorney, physician, and phone calls

(a) While confined and awaiting trial in any prison or jail in this state, no prisoner shall be denied the right to: (1) Consult an attorney of the prisoner's own choosing;(2) Call a physician of the prisoner's own choosing if in need of one; or(3) Place free telephone calls to a bondsperson if the calls are local calls.(b) Any officer or other person having charge or supervision of any prisoner in the state who refuses to permit the prisoner to consult an attorney of the prisoner's own choosing, call a physician of the prisoner's own choosing, or place free telephone calls to a bondsperson if the calls are local shall be guilty of a Class B misdemeanor.Acts 1937, No. 306, §§ 2, 3; Pope's Dig., §§ 3043, 3044; A.S.A. 1947, §§ 43-417.1, 43-417.2; Acts 2001, No. 1682, § 1; 2003, No. 1648, § 2; 2005, No. 1994, § 236.
