Section 16-123-406 - Interpretation

(a) This subchapter does not affect, interpret, or in any way address that portion of the United States Constitution, Amendment I, prohibiting laws respecting the establishment of religion or of Arkansas Constitution, Article 2, § 25, concerning protection of religion.(b) Granting government funding, benefits, or exemptions, to the extent permissible under the United States Constitution, Amendment I, prohibiting laws respecting the establishment of religion or of Arkansas Constitution, Article 2, § 25, shall not constitute a violation of this subchapter.(c) As used in this section, 'granting', with respect to government funding, benefits, or exemptions, does not include the denial of government funding, benefits, or exemptions.(d) This subchapter shall be construed in favor of a broad protection of free exercise of religious beliefs, to the maximum extent permitted by the Arkansas Constitution and the United States Constitution.Amended by Act 2023, No. 733,§ 4, eff. 8/1/2023.Added by Act 2015, No. 975,§ 1, eff. 4/2/2015.
