Section 17-36-105 - Injunctions

(a)(1) The violation of any provision of this chapter and performing or offering to perform any work or service in violation of this chapter or any provision thereof is declared to constitute a nuisance and a threat to the public health, safety, and welfare and may be enjoined by the Arkansas State Board of Architects, Landscape Architects, and Interior Designers in the courts of this state, even though the violation may be punishable by fine.(2) The intention of this section is to provide a speedy means of protecting the public.(b) The board is not required to execute or give bond for cost, indemnity, or stay as a condition to the issuance of a restraining order or injunction, either temporary or permanent, in a court of this state.Acts 2001, No. 617, § 4; 2009, No. 1367, § 16.
