Section 17-42-702 - Interference with licensee relationships prohibited

(a) No person shall knowingly interfere with a licensee relationship between a licensee and a person or entity.(b) No licensee shall be liable for a referral fee when reasonable cause for payment does not exist.(c)(1) Any person or entity aggrieved by a violation of this subchapter may bring a civil action in any court of competent jurisdiction.(2) The damages recoverable in an action under subdivision (c)(1) of this section shall be: (A) The actual damages; and(B) Reasonable attorney's fees and expenses.(d) Nothing in this subchapter is intended to:(1) Create a presumption that if reasonable cause for payment of a referral fee exists, a legal right to the referral fee exists; or(2) Authorize the payment of a referral fee that is otherwise prohibited by law or rule of the Arkansas Real Estate Commission.Amended by Act 2019, No. 315,§ 1468, eff. 7/24/2019.Acts 2005, No. 1946, § 1.
