Section 17-89-106 - Injunctions

(a) The courts of record in this state having general equity jurisdiction are vested with jurisdiction and power to enjoin the unlawful business of ophthalmic dispensing or any violation of the provisions of this chapter, with the action being brought in the county in which the alleged unlawful practice or violation occurred or in which the defendant resides, upon the complaint of any individual.(b) The issuance of an injunction by a court shall not relieve a person from criminal prosecution for violation of this chapter, but the remedy of injunction shall be in addition to criminal prosecution.Acts 1981, No. 589, § 19; A.S.A. 1947, § 72-2119.
