If any person, firm, or corporation entitled to a lien under the provisions of this subchapter shall notify, by registered mail at the last known place of address, any person, firm, or corporation holding a mortgage or a lien against the property before the work or labor is done, and within ten (10) days after mailing the notice receives no response or objection to the performance of the work or labor, then, in that event, the lien provided for in this subchapter shall take precedence over, and be superior to, any mortgage or lien held by any person so notified who makes no objection to the performance of the work or labor.Acts 1939, No. 61, § 4; A.S.A. 1947, § 51-416.
