A public utility shall not exercise any right or privilege under any franchise or permit, the exercise of which has been suspended or discontinued for more than one (1) year, without first obtaining from the Arkansas Public Service Commission or the Arkansas Department of Transportation a certificate that public convenience and necessity require the exercise of such a right or privilege.Amended by Act 2017, No. 707,§ 108, eff. 8/1/2017.Acts 1935, No. 324, § 42; Pope's Dig., § 2105; A.S.A. 1947, § 73-241.
