Section 23-4-1102 - Exemption from general rate case procedure

A generation and transmission cooperative may modify its rates and charges if:(1) At least three-fourths (3/4) of its board votes to change its rates and charges;(2) A proposed increase in the generation and transmission cooperative's rates and charges does not exceed five percent (5%) in any twelve-month period of the total gross revenues of the generation and transmission cooperative; and(3) Any additional requirements of this subchapter are satisfied.Acts 2009, No. 676, § 1.
