Section 23-87-106 - Penalties

(a) In addition to any penalty provided by law, any person who violates an order of the Insurance Commissioner after it has become final, and while the order is in effect, shall, upon proof thereof to the satisfaction of the court, forfeit and pay to the State of Arkansas a sum not to exceed two hundred fifty dollars ($250) which may be recovered in a civil action. However, if the violation is found to be willful, the amount of the penalty shall be a sum not to exceed one thousand dollars ($1,000).(b)(1) In the commissioner's discretion, the commissioner may also revoke or suspend the license or certificate of authority of the person guilty of any violation as set out in subsection (a) of this section.(2) The order for suspension or revocation shall be subject to judicial review as provided in § 23-61-307.Acts 1959, No. 148, §§ 444, 445; A.S.A. 1947, §§ 66-3818, 66-3819.
