Section 23-99-305 - Remedies

Any person adversely affected by a violation of this subchapter may bring action in a court of competent jurisdiction for injunctive relief against the healthcare insurer and, upon prevailing, in addition to such injunctive relief, shall recover damages not less than one thousand dollars ($1,000) plus attorney's fees and costs.Acts 1995, No. 515, § 5; 1995, No. 1092, § 5.
