When the Secretary of the Department of Finance and Administration is a defendant in a civil suit which seeks to recover damages from him or her personally resulting from any action taken by the secretary in his or her official capacity, the Attorney General of this state shall provide the defense for the secretary.Acts 1979, No. 401, § 44; A.S.A. 1947, § 84-4744.
