(a)(1) This subchapter shall be construed liberally.(2) All acts and activities authorized by this subchapter are legislatively determined and declared to be essential governmental functions.(b) The State Highway Commission is empowered to take such action and do or cause to be done such things as shall be necessary or desirable to accomplish and implement the purposes and intent of this subchapter according to the import of this subchapter with the action taken by the commission or the things done or caused to be done by the commission pursuant to the provisions of this subchapter being determined and declared to be ministerial rather than legislative in nature.(c) Nothing contained in this subchapter shall be construed to restrict the commission or the State of Arkansas in the issuance or incurrence of debt under other applicable laws.Acts 2003, No. 296, § 5.
